Allen Brothers – Warranty Terms & Conditions

General Warranty Principles

1.1. Allen Brothers products are designed and manufactured to a high standard. We warrant that all products supplied by Allen Brothers are of merchantable quality and fit for the purpose for which they are sold when used under normal and intended conditions.

1.2. This warranty covers defects arising solely from faulty materials or defective workmanship for a period of three (3) years from the date of purchase unless otherwise stated in this document. It does not cover failures caused by misuse, improper installation, accidental damage, excessive loads, lack of maintenance, or normal wear and tear.

1.3. In the event of a valid warranty claim, Allen Brothers will, at its discretion:
• repair the product; or
• replace the product;
No cash alternative or consequential/indirect damages will be paid unless legally required.

1.4. Nothing in these terms affects your statutory rights.

Core Catalogue Hardware Products

2.1. Core catalogue products (including blocks, cleats, travellers, fittings and accessories) are protected by Warranty against defects in materials or workmanship, subject to reasonable use.

2.2. This warranty applies only where:
• the product has been installed according to Allen Brothers’ technical instructions;
• where instructions are not provided, installation has followed accepted technical practice; products must only be used within their intended design limits, including load and technical specification. No unauthorised modification or repair has been carried out.

2.3. Products returned under warranty will be inspected and, if found defective due to manufacturing or material faults, will be replaced free of charge.

Spars, High-Load Structural and Custom Products

3.1. Due to the structural nature of spars and their exposure to variable loads, external forces and sailing conditions, spars, high-load assemblies and custom products are supplied with a Limited Warranty of two (2) years from the date of delivery or installation.

3.2. Spars, high-load structural and custom products are considered defective only where a fault is shown to arise from:
• defective materials;
• defective construction;
• defective workmanship.

3.3. The following are not covered:
• failures caused by excessive loading (including but not limited to over-tensioning, improper rig setup, or excessive backstay loads);
• damage resulting from capsize, collision, grounding, or impact;
• fatigue, wear and tear, cosmetic surface damage or corrosion;
• use outside the design limits or intended sailing conditions;
• unauthorised repairs, alterations or modifications.

3.4. The warranty applies only where the spar has been installed, tuned and operated in accordance with Allen Brothers rigging guidelines and the vessel configuration supplied by the owner at the point of order has not been materially changed.

3.5. Structural components must be returned promptly to Allen Brothers or an authorised dealer for inspection. Shipping costs are to be paid by the customer.

Claim Procedure

4.1. Any suspected defect must be reported to Allen Brothers within seven (7) days of discovery. Claims received outside this period may be rejected.

4.2. Returned goods must be accompanied by:
• proof of purchase;
• a detailed description of the circumstances leading to the failure;
• photographs where possible;
• confirmation of the installation method used.

4.3. Allen Brothers will inspect the product and determine whether the claim is valid under the terms of this warranty.

Limitations of Liability

5.1. This warranty is provided in place of all other warranties or representations, whether express or implied, statutory or otherwise, except where such exclusions are prohibited by law.

5.2. Allen Brothers is not responsible for:
• incidental, indirect or consequential losses;
• loss of use, loss of racing results, loss of charter income;
• damage to surrounding equipment due to the failure of a component.

5.3. Maximum liability is limited to repair or replacement of the defective product as set out in these terms.

Governing Law

6.1. These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the United Kingdom.
